Article - 1: This seasonal rental contract is reserved for the exclusive use of stays in
classified tourist accommodation.
"L'appart de Lary" is classified 4 stars (classification number 06503065-6538823-0247 for a period of 5 years untilOctober 30, 2028. It received the “Accommodation Comfort quality” label5 diamonds for a period of 5 years until October 30, 2028.
Article - 2:
Length of stay,
The tenant signing this contract concluded for a fixed period may not under any circumstances claim any right to remain on the premises at the end of the stay.
Article – 3:
Conclusion of the contract,
The reservation becomes effective once the tenant has sent the owner a deposit of 30% of the total rental amount and a copy of the signed contract before the date indicated.
The lease concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, whether natural or legal persons, unless otherwise agreed in writing by the lessor. Any breach of this last paragraph may result in the immediate termination of the lease due to the tenant's fault, with the proceeds of the lease remaining definitively acquired by the lessor.
Article – 4:
Cancellation by the tenant
Weather conditions are not a valid reason for cancellation without charge.
a) cancellation before arrival at the premises:
Any cancellation must be notified in writing (email or letter...).
If cancellation occurs more than 30 days before the date of arrival, the 30% payment (deposit) will be refunded to you.
Cancellation occurs less than 30 days before the date of arrival at the premises, the payment of 30% (deposit) remains acquired and payment of the balance of the stay is required.
If the tenant does not show up within 24 hours of the arrival date indicated on the contract, this contract becomes null and void and the lessor can dispose of his apartment. The deposit also remains acquired by the lessor who will request the balance of the rental.
b) if the stay is shortened, the rental price remains acquired by the lessor. In this case, no refund will be made.
Article - 5:
Cancellation by the lessorThe lessor pays the tenant the full amount paid.
Article – 6:
Arrival,
The tenant must arrive on the day and at the time specified in this contract. In the event of late or delayed arrival, the tenant must notify the lessor.
Article – 7:
Settlement of balance
: The tenant agrees to pay the lessor the balance of the rental, namely the price of the stay less the deposit paid. The payment of the balance of the stay is to be settled 15 days before arrival at the rental either by credit card, transfer or PayPal, accompanied by the security deposit of €800 and the cleaning fee of €90.
Article 8 -
Payment of charges
: Water and electricity charges are included in the rental price, for normal use. In the event of abnormal use, the charges may be re-invoiced to the tenant.
For the comfort of our tenants, Lary's apartment offers extras:
An end-of-stay cleaning package, a meal on arrival, rental of bed linen, towels and childcare equipment (travel cot, high chair, bath seat, stroller, etc.) and on request the beds can also be made on arrival.
Article -9:
Tourist tax
The tourist tax is a local tax that the tenant must pay to the lessor who then pays it to the public treasury. The tax depends on the category of accommodation and the number of people staying there.
It amounts to 2.61 euros per night per person (exemption for minors).
Article – 10:
State of play, The apartment is rented furnished and equipped as it is in the attached description. This inventory is established by the owner. It constitutes the only reference in the event of a dispute concerning the condition of the premises. All installations are in working order and any claim concerning them arising more than 24 hours after taking possession of the premises will not be admissible. Repairs made necessary by negligence or poor maintenance during the rental period will be the responsibility of the tenant.
Article – 11:
Security deposit,
the tenant pays the lessor a security deposit of a value of800 euros. After the contradictory establishment of the inventory of fixturesupon departure, this deposit is returned, less the cost of restoring the premises if damage is found. The security deposit is reimbursed by the lessor within a period not exceeding one month.
Article – 12:
Use of premisesThe tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises. The apartment is non-smoking.
Cleaning the apartment is the responsibility of the tenant during the rental period and before departure (if he has chosen to do so).
If the apartment is returned in good condition, the cleaning deposit will be returned to you at the end of your stay.
If not, it will be collected by the owner.
In the event of abnormal use of the apartment, or exceptional dirtiness, the cleaning fee (90 euros) will be charged to the tenant.
Article – 13:
Ability, This contract is established for a maximum capacity of 6 people. If the number of tenants exceeds the capacity, the lessor may refuse the additional persons. Any modification or termination of the contract will therefore be considered at the initiative of the tenant.
Article - 14:
Animals
: The tenant cannot stay with a pet. In the event of non-compliance with this clause by the tenant, the lessor may refuse the stay. In this case, no refund will be made.
Article – 15:
InsuranceThe tenant certifies that he is covered by civil liability insurance covering his own liability and that of the persons accompanying him.
Article – 16:
Disputes
: Any claim relating to the rental will be handled by the competent Court.
